By accessing, browsing, registering an account, submitting a listing, or making a purchase on the Site, you agree to be bound by these Terms, including any future amendments and additions. If you do not agree to these Terms, you may not use the Site or its services.
These Terms are presented to you and accepted by you at the point of Registration, Listing Submission, and Checkout.
1. Acceptance of Terms
1.1 General Acceptance: Your use of the Site constitutes your unconditional agreement to these Terms. You represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into this agreement.
1.2 Incorporation: These Terms incorporate by reference any other policies or disclaimers posted on the Site, including our Privacy Policy.
2. Registration and Account Terms (Terms at Registration)
2.1 Account Creation: To access certain features, including submitting a listing, you must register for an account. By registering, you agree to:
- Provide accurate, current, and complete information as prompted by the registration forms (“Registration Data”).
- Maintain the security of your password and identification.
- Maintain and promptly update the Registration Data, and any other information you provide, to keep it accurate and complete.
- Accept all risks of unauthorized access to the Registration Data and any other information you provide to us.
2.2 Attorney/Firm Status: If you are registering as an attorney or law firm, you represent and warrant that:
- You are a licensed attorney in good standing in the state(s) you claim to practice in.
- All information provided in your profile and listing is truthful and complies with all applicable rules of professional conduct and ethical guidelines in your jurisdiction.
2.3 Prohibited Use: You may not use the account or Site to engage in any unethical, unprofessional, or illegal activities.
3. Listing Terms and Conditions (Terms for Listing)
3.1 Eligibility: Listing services are exclusively available to licensed attorneys and law firms who comply with the ethical standards and laws of their practicing jurisdiction(s).
3.2 Content Submission: By submitting, posting, or displaying content (including firm name, address, phone number, practice areas, biographies, and photos) (“Listing Content”), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, distribute, and display such Listing Content on the Site and in promotional materials.
3.3 Content Accuracy and Compliance: You are solely responsible for all Listing Content you submit and agree that:
- All Listing Content is accurate, current, and not misleading.
- All Listing Content strictly complies with all applicable bar association rules, advertising regulations, and laws in all jurisdictions where you practice or solicit clients. This includes, but is not limited to, rules regarding solicitation, specialty claims, and required disclaimers.
- You shall immediately update or remove any Listing Content that becomes outdated, inaccurate, or non-compliant.
3.4 Review and Removal: We reserve the right, but have no obligation, to review, reject, or remove any Listing Content for any reason, including violation of these Terms or ethical standards, without refund.
3.5 No Attorney-Client Relationship: You acknowledge that FindAttorneys.org is an attorney directory and advertising platform, not a law firm. No attorney-client relationship is created or implied between us and any user (either attorney or potential client) of the Site.
4. Purchases, Fees, and Checkout (Terms at Checkout Page)
4.1 Service Fees: Services offered on the Site (e.g., premium listings, advertisements, feature packages) require payment of a fee (the “Fee”), as specified on the relevant service or checkout page.
4.2 Payment: All Fees are payable in [Currency, e.g., USD] and must be paid using the payment methods accepted by the Site. You authorize us to charge your selected payment method for all Fees.
4.3 Automatic Renewal: If you purchase a recurring service (e.g., a monthly or annual listing subscription), you authorize us (without notice to you, unless required by applicable law) to collect the Fee and any applicable taxes, using any credit card or payment account we have on record for you. The subscription will automatically renew at the then-current rate unless you cancel the service at least [e.g., five (5) days] before the end of the current billing cycle.
4.4 Refunds and Cancellations:
- All Fees are non-refundable, except as explicitly stated in a separate written agreement or as required by law.
- Cancellation of a recurring service will take effect at the end of the current paid billing cycle. You will not receive a refund for any time remaining on your subscription.
4.5 Pricing Changes: We reserve the right to change our prices for services and subscriptions at any time. We will provide you with reasonable advance notice of any such changes.
5. Disclaimers and Limitation of Liability
5.1 Disclaimer of Warranties: The Site and all content, listings, and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
5.2 Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Site; (b) any conduct or content of any third party on the Site, including without limitation, any defamatory, offensive, or illegal conduct of other users or attorneys; (c) any content obtained from the Site; or (d) unauthorized access, use, or alteration of your transmissions or content.
5.3 No Endorsement: We do not endorse or recommend any specific attorney or firm listed on the Site. We make no representations regarding the quality of legal services provided by any listed attorney.
6. Termination
6.1 By Us: We may terminate or suspend your account, listing, or access to the Site, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms, or if we believe your Listing Content violates professional conduct rules.
6.2 By You: You may terminate your account at any time by contacting us at findattorneyshere@gmail.com. Termination of your account does not entitle you to a refund of any prepaid Fees.
